Terms of Service

These Terms of Service ("Terms") govern your access to and use of the photo galleries hosted on Pixieset (the "Galleries") containing photographs taken at conferences, forums, and events organised by Mare Forum B.V. ("Mare Forum", "we", "us"). By accessing a Gallery or downloading any photograph, you agree to these Terms.

1. Access to the Galleries

1.1. Galleries may be protected by a password or PIN provided to event participants. Access credentials are intended for registered attendees, speakers, sponsors, and partners of the relevant Mare Forum event and may not be shared publicly (for example, on websites, social media, or mailing lists).

1.2. Mare Forum may restrict, suspend, or withdraw access to any Gallery at any time without notice.

2. Copyright and Ownership

2.1. All photographs in the Galleries are the property of Mare Forum B.V. and/or the commissioned photographer, and are protected by copyright law. Nothing in these Terms transfers ownership of any photograph to you.

2.2. Downloading a photograph grants you a limited, non-exclusive, non-transferable licence to use it as described in Section 3. This licence may be revoked at any time.

3. Permitted Use

Subject to these Terms, event participants and their organisations may use downloaded photographs for:

  • Personal, non-commercial purposes (e.g., personal social media posts, keepsakes);

  • Professional and corporate communications relating to their participation in the event, including company websites, newsletters, LinkedIn and other social media, presentations, and internal reports;

  • Press and media coverage of the event.

When photographs are published, credit should be given as: "Photo courtesy of Mare Forum" (or the photographer credit indicated in the Gallery, where applicable).

4. Prohibited Use

You may not:

  • Sell, license, sublicense, rent, or otherwise commercially exploit any photograph;

  • Use any photograph in advertising for products or services unrelated to the Mare Forum event, or in a way that implies endorsement by Mare Forum or by any person depicted;

  • Alter photographs beyond reasonable cropping, resizing, or minor colour adjustment; adding filters, text overlays, or composites that materially change the image is not permitted without prior written consent;

  • Use photographs in any context that is defamatory, misleading, unlawful, or that could reasonably be considered damaging or embarrassing to any person depicted;

  • Remove or obscure any watermark, credit, or metadata embedded in a photograph;

  • Use photographs (or the Galleries) to train, fine-tune, or otherwise develop machine-learning or generative AI models.

5. Photographs of Individuals

5.1. Photographs in the Galleries were taken at Mare Forum events, where photography and filming are conducted for documentation and promotional purposes, as communicated to participants at registration and/or on-site.

5.2. If you appear in a photograph and would like it removed from a Gallery, or if you object to a specific use of your image, please contact us at privacy@mareforum.com. We will handle such requests in accordance with the EU General Data Protection Regulation (GDPR) and will remove the photograph from the Gallery within a reasonable time, unless a legal basis for continued publication applies.

5.3. If you download and republish a photograph depicting other identifiable individuals, you are responsible for ensuring your use complies with applicable privacy and data protection laws.

6. Third-Party Platform

The Galleries are hosted on Pixieset, a third-party service. Your use of Pixieset is additionally subject to Pixieset's own terms of service and privacy policy. Mare Forum is not responsible for the availability, security, or operation of the Pixieset platform.

7. No Warranty; Limitation of Liability

7.1. The Galleries and photographs are provided "as is", without warranties of any kind, whether express or implied.

7.2. To the maximum extent permitted by law, Mare Forum shall not be liable for any indirect, incidental, or consequential damages arising from your access to or use of the Galleries or photographs. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Changes to These Terms

We may update these Terms from time to time. The version published in or linked from the Gallery at the time of your access applies. Continued use of a Gallery after changes are published constitutes acceptance of the updated Terms.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands. Any dispute arising from these Terms or the use of the Galleries shall be submitted to the competent court in Rotterdam, the Netherlands.
